At LUYEN TRAN HOLDINGS PTY LTD our aim is to provide customers with superior service. If you have concerns with the level of service received, it is important that we are aware of the issue and have an opportunity to restore your confidence.
In the first instance, we recommend speaking with the person with whom you originally dealt to see if an amicable outcome can be achieved. If the matter remains unresolved, you may escalate it to our Dispute Resolution Officer.
When we receive a complaint, the Dispute Resolution Officer will attempt to resolve it promptly. We expect both parties to make a genuine attempt to resolve the complaint, provide relevant information and documents, and comply with reasonable requests for information within a reasonable timeframe.
Unless there are exceptional circumstances, we will respond within 30 days of receiving the initial contact. If we cannot resolve the complaint within 30 days, we will advise the reason for the delay and specify a date when a decision can reasonably be expected.
If we do not reach agreement on your complaint, you may refer the matter to the Australian Financial Complaints Authority (AFCA), an ASIC-approved external dispute resolution scheme. AFCA is a free service established to provide an independent mechanism to resolve eligible complaints.
Time limits may apply to complaints to AFCA. You should act promptly or consult the AFCA website to understand whether a time limit applies to your circumstances.
This policy is for LUYEN TRAN HOLDINGS PTY LTD (“we”, “us”, “our”), an Australian Privacy Principles (APP) entity as defined in the Privacy Amendment (Enhancing Privacy Protection) Act 2012. It outlines who we are, the types of personal information we collect, how we collect, hold, use and disclose information, direct marketing, cross-border disclosure, security, access and correction, complaints, changes to the policy and contact details.
We are finance brokers. We provide credit assistance when we suggest or assist you to apply for a credit contract with a credit provider, apply for an increase to a credit limit, or remain in a particular credit contract. You engage us to arrange a loan on your behalf and acknowledge that we act as an independent contractor to assist you to obtain and negotiate a loan.
We have access to a panel of financiers and offer a variety of finance and insurance products, both consumer and commercial, tailored to customer needs and objectives.
Personal information is information or an opinion about an identified individual or an individual who is reasonably identifiable. Examples include name, signature, residential, business or email address, telephone number, date of birth, medical records, bank account details, expenditure details, employment details and credit report information such as credit history, accounts, repayment history, enquiries, defaults and bankruptcy information.
Sensitive information may include information about racial or ethnic origin, political opinions, religious beliefs, criminal record or health information. We generally do not collect sensitive information unless it is reasonably necessary for our function or activity and we have your consent.
In most cases, we collect personal information directly from you when you apply for a finance or insurance product. With your consent, we may also collect information from third parties such as employers, accountants, banks or referrers.
We collect personal information to provide finance and insurance products you request. We collect and store information subject to Australian privacy and credit reporting laws, including the Privacy (Credit Reporting) Code 2024. If we proceed with providing finance or insurance products, we may hold personal information for seven years after the finance contract has ceased, after which we delete information no longer required.
We may disclose personal information to financiers, insurers, credit reporting bodies, employers, banks, solicitors or accountants to verify information, suppliers where an asset is being purchased, and referees or contacts where we are unable to contact you.
You may choose not to identify yourself or to use a pseudonym when dealing with us for general enquiries. If you apply for finance or insurance, we will need to identify you because your information is required to support the application.
If we receive unsolicited personal information, we will determine whether we could have collected it by lawful and fair means and whether it is reasonably necessary. If not, we will destroy or permanently de-identify it.
We may use personal information to market additional products or services available via our group or third parties by email, telephone, social media, SMS, mail or other electronic means. We do not sell your personal information to organisations outside our group. You may opt out at any time by contacting us, and we will generally stop sending direct marketing material within 30 days of receiving the request.
Our group operates in Australia; however, we may share information with affiliated organisations or service providers outside Australia, including Germany, New Zealand, the United Kingdom, the Philippines, India, Singapore, Japan, Malaysia, Vietnam and the United States of America. Because electronic or networked storage may be accessed from various countries, disclosures may occur in countries other than those listed.
As part of the finance application process, we may collect government-related identifiers that appear on documents, such as driver licence numbers, passport numbers and tax file numbers. We do not use government identifiers to identify your application where we can use your name or application number. We take reasonable steps to permanently de-identify any tax file number that appears on documents where it is not required.
We make reasonable efforts to keep personal information accurate, up to date and complete. We use security measures including confidentiality requirements, document storage policies, system access controls, premises security, firewalls and data encryption. If we store information with third-party data storage providers, we use contractual arrangements to require appropriate security controls.
You may request access to personal information we hold about you. In certain circumstances, we may decline access, such as where there is a threat to life or public safety, unreasonable impact on others, frivolous requests, legal proceedings, unlawful disclosure or commercial confidentiality concerns. If we cannot provide the requested information, we will advise the reasons in writing and explain how you can complain.

As an authorised credit representative, Kinetic Capital is committed to meeting responsible lending obligations by ensuring that any credit product recommended to a consumer is suitable for their financial situation and objectives. This involves making reasonable inquiries into the consumer’s financial situation, needs and objectives; verifying the consumer’s financial situation where necessary; and assessing whether the proposed credit contract or consumer lease is not unsuitable for the consumer.
